1. INTRODUCTION
This Privacy Policy describes how PayFarGo, Inc. (“PayFarGo”, “we”, “us”, or “our”) collects, uses, shares, stores, and protects the personal information of individuals who access or use our Platform and remittance services (“Services”). This Policy applies to all users of the PayFarGo Platform in the United States, including all 50 states, the District of Columbia, and U.S. territories.
This Privacy Policy is designed to comply with applicable U.S. federal and state privacy laws, including the Gramm-Leach-Bliley Act (GLBA), the California Consumer Privacy Act (CCPA/CPRA), and other applicable state privacy statutes. By using our Platform, you agree to the practices described in this Policy.
2. INFORMATION WE COLLECT
2.1 Information You Provide Directly
- Identity Data: Full legal name, date of birth, and government-issued ID number (e.g. driver’s licence, passport, or state ID).
- Contact Data: Email address, phone number, and residential and mailing address.
- Financial Data: Bank account details, debit/credit card information, and payment method details.
- KYC/AML Data: Social Security Number (SSN) or ITIN (where required by law), source of funds information, and employment details.
- Transaction Data: Details of transfers you initiate, including recipient information, amounts, and destinations.
- Account Data: Username, password (hashed), and account settings and preferences.
- Support and Communications Data: Records of your communications with our customer support team.
2.2 Information Collected Automatically
- Device Data: IP address, device type, operating system, browser type, and unique device identifiers.
- Usage Data: Pages visited, time and duration of visits, clickstream data, and navigation patterns.
- Location Data: Approximate geo-location derived from your IP address, and precise location if permitted by your device settings.
- Cookies and Tracking Technologies: We use cookies, web beacons, and similar technologies to enhance your experience and analyse Platform usage. See our Cookie Policy for details.
2.3 Information Received from Third Parties
- Identity verification partners (for KYC/AML screening).
- Credit reporting and fraud prevention agencies.
- Banking and payment processing partners.
- Government databases and watchlists (OFAC, FinCEN) for sanctions screening.
- Social media platforms, if you choose to link your account.
3. HOW WE USE YOUR INFORMATION
PayFarGo uses your personal information for the following purposes.
3.1 Service Delivery and Account Management
- To register and manage your PayFarGo account.
- To process and complete remittance transactions.
- To verify your identity and meet our KYC/AML obligations under the BSA and USA PATRIOT Act.
- To communicate with you about your account and transactions.
3.2 Legal and Regulatory Compliance
- To comply with applicable federal and state money transmission laws.
- To file required reports—including Currency Transaction Reports (CTRs) and Suspicious Activity Reports (SARs)—with FinCEN.
- To screen users and transactions against OFAC sanctions lists.
- To respond to lawful requests from law enforcement and regulatory authorities.
- To maintain records as required by the BSA and applicable state laws.
3.3 Fraud Prevention and Security
- To detect, investigate, and prevent fraud, money laundering, and other financial crimes.
- To protect the security of the Platform and user accounts.
- To conduct risk assessments and due diligence.
3.4 Platform Improvement and Analytics
- To analyse usage patterns and improve the Platform’s functionality and user experience.
- To develop new products and features.
- To conduct internal research and analytics.
3.5 Marketing and Communications (with your consent)
- To send you promotional materials, newsletters, and information about new features or services.
- To personalise your experience on the Platform.

4. LEGAL BASIS FOR PROCESSING
We process your personal information on the following lawful bases:
- Contract: Processing necessary to deliver our Services and fulfil our obligations to you.
- Legal Obligation: Processing required to comply with applicable federal and state law—including the BSA, AML regulations, OFAC rules, and CFPB requirements.
- Legitimate Interests: Processing for fraud prevention, platform security, and business analytics, where not overridden by your rights.
- Consent: Processing for optional features such as marketing communications, where you have provided explicit consent.
5. INFORMATION SHARING AND DISCLOSURE
PayFarGo does not sell your personal information. We may share your information in the following circumstances.
5.1 Service Providers and Partners
- Licensed banking and payment processing partners (for transaction execution).
- Identity verification and KYC/AML service providers.
- Cloud hosting, IT infrastructure, and cybersecurity providers.
- Customer support platforms.
- Analytics and Platform improvement vendors.
5.2 Legal and Regulatory Disclosures
- FinCEN, OFAC, the CFPB, and other federal and state regulatory authorities, as required by law.
- Law enforcement agencies pursuant to lawful subpoenas, court orders, or other legal process.
- Other parties where disclosure is required or permitted by applicable law.
5.3 Business Transfers
In the event of a merger, acquisition, sale of assets, or other business transaction, your information may be transferred to a successor entity, subject to equivalent privacy protections.
5.4 With Your Consent

6. STATE-SPECIFIC PRIVACY RIGHTS

6.2 Virginia (VCDPA)
Virginia residents have the right to access, correct, delete, and obtain a portable copy of their personal data, and to opt out of targeted advertising and profiling.
6.3 Colorado (CPA)
Colorado residents have the right to access, correct, and delete personal data, and to opt out of the sale of personal data and targeted advertising.
6.4 Connecticut (CTDPA)
Connecticut residents have rights of access, correction, deletion, portability, and opt-out of targeted advertising.
6.5 Texas (TDPSA)
Texas residents may access, correct, delete, or obtain personal data and opt out of targeted advertising and profiling.
6.6 Nevada (NRS)
Nevada residents may opt out of the sale of covered information to third parties.
6.7 All Other States
Users in all U.S. states are afforded the privacy protections of the Gramm-Leach-Bliley Act (GLBA) with respect to financial information. You may contact us at support@payfargo.com to submit a request regarding your personal information, and PayFarGo will respond in accordance with applicable law.
7. YOUR RIGHTS AS A DATA SUBJECT
Subject to applicable law, you have the following rights with respect to your personal information:
- Right of Access: Request a copy of the personal information we hold about you.
- Right to Rectification: Request correction of inaccurate or incomplete information.
- Right to Deletion: Request deletion of your personal information, subject to legal retention obligations.
- Right to Portability: Request your personal information in a structured, machine-readable format, where applicable.
- Right to Opt Out of Marketing: Opt out of receiving marketing communications at any time.
- Right to Non-Discrimination: We will not discriminate against you for exercising your privacy rights.

8. DATA RETENTION
PayFarGo retains your personal information for as long as necessary to fulfil the purposes for which it was collected, to provide our Services, and to comply with applicable legal and regulatory obligations. Under the Bank Secrecy Act, we are required to retain certain transaction records for a minimum of five (5) years. Once applicable retention periods have passed, personal information is securely deleted or anonymised.
9. DATA SECURITY
PayFarGo uses industry-standard technical, administrative, and physical safeguards to protect your personal information from unauthorised access, use, disclosure, alteration, or destruction. These measures include encryption of data in transit and at rest, multi-factor authentication, access controls, regular security audits, and incident response procedures. No security system is impenetrable, however, and PayFarGo cannot guarantee the absolute security of your information.
In the event of a data breach that is likely to result in risk to your rights, PayFarGo will notify affected users and, where required, relevant authorities, in accordance with applicable state data breach notification laws.
10. COOKIES AND TRACKING TECHNOLOGIES
PayFarGo uses cookies, web beacons, pixel tags, and similar technologies to enhance your experience on the Platform, analyse usage, and deliver relevant content. You can manage your cookie preferences through your browser settings or our in-Platform cookie management tool. Some features of the Platform may not function correctly if cookies are disabled.

11. CHILDREN’S PRIVACY
The PayFarGo Platform is not intended for individuals under 18 years of age. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a minor, please contact us immediately at support@payfargo.com and we will take steps to delete that information. Our practices comply with the Children’s Online Privacy Protection Act (COPPA), 15 U.S.C. § 6501 et seq.
12. THIRD-PARTY LINKS AND SERVICES
Our Platform may contain links to third-party websites, applications, or services. PayFarGo is not responsible for the privacy practices or content of such third parties. We encourage you to review the privacy policies of any third-party services you access through our Platform.
13. CHANGES TO THIS PRIVACY POLICY
PayFarGo may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons. We will notify you of material changes by updating the Effective Date at the top of this Policy and, for significant changes, by sending a notification to your registered email address or through the Platform. Your continued use of the Platform after such notice constitutes acceptance of the updated Privacy Policy.
