PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE PAYFARGO PLATFORM. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS IN THEIR ENTIRETY. IF YOU DO NOT AGREE, YOU MUST IMMEDIATELY DISCONTINUE USE OF OUR PLATFORM.
These Terms of Use ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("User", "you", "your"), and PayFarGo, Inc. ("PayFarGo", "Company", "we", "us", or "our"), a corporation organized and operating under the laws of the United States of America, concerning your access to and use of the PayFarGo platform, website, mobile application, and any related services (collectively, the "Platform" or "Services"). These Terms apply to all users in every state and territory of the United States of America.
Supplemental terms, policies, or documents posted on the Platform from time to time are incorporated herein by reference. We reserve the right to modify these Terms at any time, and will notify you of material changes by updating the "Last Updated" date above. Your continued use of the Platform after such updates constitutes acceptance of the revised Terms.
1. Introduction and Scope
These Terms govern your use of PayFarGo's international money remittance services ("Remittance Services"), digital platform, and any associated financial services offered through PayFarGo and its licensed partners.
These Terms constitute a contract between you and PayFarGo. You may not use the service if you do not accept these Terms. By using any part of the Service you accept these Terms. If you are under eighteen (18) years of age, you may not use the Service. By using the Service or any of the products you accept the Terms and Conditions of PayFarGo providing the services, as applicable based on the technical integration of the Service. You agree that any or all Terms and Conditions may apply to you, depending on the entity providing the services.
Subject to these terms, we grant you a limited, personal, non-transferable, and non-exclusive licence to access and use the Service, including any related software through which the Service is made available.
You shall not, and shall not permit any third party to, copy, reproduce, decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works from the software, except where such restrictions are expressly prohibited by applicable law or permitted under the licensing terms governing any incorporated open-source components.
PayFarGo enables individuals in the United States, including members of the diaspora community, to securely transfer funds internationally to recipients abroad.
By creating a PayFarGo account or initiating a transaction, you agree to be legally bound by:
- These PayFarGo Terms of Use;
- Our Privacy Policy (incorporated herein);
- Our Acceptable Use Policy;
- Any applicable partner or licensed institution terms; and
- All applicable US federal and state laws and regulations governing money transmission and financial services.
These Terms become effective as soon as you:
- Click and accept these terms or Privacy Policy;
- Click and accept the Privacy Policy of our Partners;
- Start using our Services;
- Start using this Website.
Whichever happens first.
If you do not agree to these Terms in their entirety, you must immediately cease use of the Platform.
2. About PayFarGo
PayFarGo, Inc. is a US-based financial technology company specializing in international money remittance services. PayFarGo enables individuals in the United States to send funds to recipients in designated countries efficiently, transparently, and securely. PayFarGo operates in compliance with applicable federal and state money transmission laws and works with licensed financial institutions and payment processors to facilitate cross-border transfers.
Important disclosures regarding PayFarGo's role:
- PayFarGo is a licensed money services business (MSB) registered with the Financial Crimes Enforcement Network (FinCEN) of the U.S. Department of the Treasury.
- PayFarGo is not a bank and does not offer bank deposit accounts or FDIC-insured products.
- Funds transferred through PayFarGo are not insured by the Federal Deposit Insurance Corporation (FDIC) or any government agency.
- PayFarGo partners with licensed banks, payment processors, and local disbursement agents in destination countries to complete transfers.
3. Eligibility and Age Requirements
To access and use PayFarGo's Services, you must satisfy all of the following eligibility criteria:
a. You must be at least 18 years of age;
b. You must be a legal resident or citizen of the United States, or lawfully present in the United States with authorization to enter into binding contracts;
c. You must have a valid US residential address;
d. You must successfully complete PayFarGo's identity verification and Know-Your-Customer (KYC) onboarding process;
e. You must not be subject to any US government sanctions, watchlists, or be designated as a Specially Designated National (SDN) by the Office of Foreign Assets Control (OFAC);
f. You must not be prohibited from using financial services under applicable federal, state, or local law.
PayFarGo reserves the right to refuse service, suspend accounts, or terminate access for any user who does not satisfy these eligibility requirements or who provides false or misleading information during the registration process.
4. Account Registration and Onboarding
To use PayFarGo's Services, you must register for an account. During registration, you agree to:
- Provide complete, accurate, and truthful information;
- Promptly update your information whenever it changes;
- Undergo identity verification and KYC/AML screening by PayFarGo and/or its third-party partners;
- Permit PayFarGo to verify your identity using government-issued identification and third-party verification providers;
- Permit PayFarGo to conduct credit, fraud, or risk assessments as required by law or operational necessity.
Account Security
You are solely responsible for:
- Maintaining the confidentiality and security of your login credentials, including your username, password, and any multi-factor authentication codes;
- All activity that occurs under your account, whether authorized or unauthorized;
- Immediately notifying PayFarGo at support@payfargo.com of any unauthorized access, suspected breach, or loss of credentials.
PayFarGo will never ask you for your password via email, phone, or any other channel. You must not share your account credentials with any third party.
User Responsibility for Transfer Details
You are solely responsible for ensuring that all information provided in connection with any Transaction is complete, accurate, and up to date, including, without limitation, the recipient's name, bank account details, mobile wallet information, and any other required identifiers.
PayFarGo shall rely on the information you provide when processing Transactions and shall have no obligation to verify the accuracy of such information. You acknowledge and agree that Transactions may be processed based solely on the account number, wallet ID, or other unique identifier you provide, even if such identifier corresponds to a person or account other than the named recipient.
PayFarGo shall not be liable for any loss, delay, misdirection, or failed delivery of funds arising from incorrect, incomplete, or misleading information provided by you. Where a Transaction has been executed in accordance with the details you supplied, it shall be deemed properly authorized and correctly completed.
You acknowledge that once a Transaction has been submitted for processing, it may not be possible to cancel, reverse, or recover the funds, particularly where the funds have already been credited to the recipient's account. PayFarGo will use reasonable efforts to assist in the recovery of funds where an error is reported, but does not guarantee that such recovery will be successful.
5. Remittance Services
5.1 How Our Services Work
PayFarGo provides a platform through which users in the United States can initiate international money transfers ("Remittances") to designated recipients in supported destination countries. Upon your instruction, PayFarGo, through its licensed banking and payment partners, will process the transfer of funds in accordance with your instructions and applicable exchange rates.
5.2 Transfer Limits
PayFarGo imposes transaction limits in accordance with US regulatory requirements, including:
- Per-transaction limits set in accordance with FinCEN reporting thresholds;
- Daily, weekly, and monthly cumulative transfer limits based on your verification tier;
- Limits required by the Bank Secrecy Act (BSA) and applicable state money transmission statutes.
Users may be required to provide additional documentation for transfers that exceed applicable reporting thresholds or that trigger enhanced due diligence procedures.
5.3 Exchange Rates and Fees
PayFarGo will disclose the applicable exchange rate and all fees (including transfer fees, FX margins, and any third-party fees) prior to your authorization of any transaction. You acknowledge and agree that:
- Exchange rates fluctuate and are set at the time of your transaction;
- PayFarGo may earn revenue from the difference between the mid-market exchange rate and the rate offered to you;
- Fee schedules are available on the PayFarGo platform and may be updated from time to time with notice;
- Third-party recipient banks or mobile money operators may impose additional fees upon receipt.
5.4 Cancellations and Refunds
In accordance with the Consumer Financial Protection Bureau (CFPB) Remittance Transfer Rule, users have the right to cancel a remittance transfer within 30 minutes of payment, provided the funds have not yet been picked up or deposited by the recipient. To request a cancellation, contact PayFarGo immediately at support@payfargo.com or via the Platform. Refunds for eligible cancellations will be processed within 3 business days.
5.5 Error Resolution
If you believe an error has occurred in connection with your transfer—including an incorrect amount, wrong recipient, or failed delivery—you must notify PayFarGo within 180 days of the transfer date. PayFarGo will investigate and resolve valid errors in accordance with the CFPB Remittance Transfer Rule and applicable law. You may be required to provide documentation to support your error claim.
6. US Federal and State Regulatory Compliance
6.1 Federal Compliance
PayFarGo operates in compliance with all applicable United States federal laws and regulations governing money transmission and financial services, including but not limited to:
- The Bank Secrecy Act (BSA) and applicable anti-money laundering (AML) regulations;
- The USA PATRIOT Act and customer identification requirements;
- The Electronic Fund Transfer Act (EFTA) and Regulation E;
- The Consumer Financial Protection Bureau (CFPB) Remittance Transfer Rule;
- Office of Foreign Assets Control (OFAC) sanctions programs; and
- The Gramm-Leach-Bliley Act (GLBA) relating to data privacy and safeguarding.
6.2 State Licensing and Compliance
PayFarGo is licensed as a money transmitter, or operates through duly licensed partners, in the states and territories where its Services are offered, as required by applicable law.
Where required, PayFarGo maintains appropriate surety bonds and complies with state-level consumer protection, disclosure, and reporting obligations.
6.3 User Acknowledgment
By using the Services, you acknowledge that your transactions are subject to applicable federal and state laws, including consumer protection laws governing electronic fund transfers and remittance services.
You may contact your state financial regulator or the Consumer Financial Protection Bureau (CFPB) for additional information regarding your rights.
7. Prohibited Uses
You may not use the PayFarGo Platform for any of the following purposes:
7.1 Illegal Financial Activity
- Money laundering, terrorist financing, or financing of proliferation of weapons of mass destruction;
- Fraud, identity theft, unauthorized use of another person's financial accounts, or any form of financial crime;
- Transactions that violate OFAC sanctions or involve Specially Designated Nationals (SDNs) or blocked persons;
- Structuring transactions to evade reporting requirements ("smurfing") in violation of 31 U.S.C. § 5324;
- Tax evasion or any transaction intended to circumvent IRS reporting obligations.
7.2 Unauthorized or Harmful Conduct
- Using the Platform on behalf of a third party without their knowledge and consent;
- Providing false or misleading information during registration or transactions;
- Circumventing security controls, rate limits, or access restrictions;
- Unauthorized data scraping, crawling, or harvesting;
- Uploading or transmitting malware, viruses, Trojan horses, or any harmful code;
- Attempting to reverse-engineer, decompile, or disassemble any portion of the Platform;
- Creating accounts by automated means or under false pretenses.
7.3 Other Prohibited Activities
- Gambling, wagering, or lottery-related transactions;
- Purchase of illegal goods, narcotics, counterfeit products, or services;
- Any activity that violates applicable federal, state, or local law or regulation.
PayFarGo reserves the right to investigate suspected violations, suspend or terminate accounts, report suspicious activity to relevant authorities (including FinCEN and law enforcement), and cooperate fully with regulatory investigations.
8. Fees and Payment
PayFarGo charges fees for the use of its Services, including but not limited to:
- Transfer/remittance fees per transaction;
- Foreign exchange (FX) margin included in applicable exchange rates;
- Any applicable third-party recipient fees (disclosed where known).
All applicable fees will be clearly disclosed to you before you authorize a transaction, in compliance with the CFPB Remittance Transfer Rule. By completing a transaction, you authorize PayFarGo to deduct the disclosed fees from your payment. PayFarGo may update its fee schedules from time to time, and will provide reasonable notice of material fee changes.
You agree to provide accurate and current payment method information. All payments are processed in US Dollars (USD). You authorize PayFarGo to charge your designated payment method for all authorized transactions and fees.
9. Intellectual Property
All intellectual property rights in the PayFarGo Platform, including but not limited to the website, mobile application, trademarks, logos, software, design, text, graphics, and documentation, are owned exclusively by PayFarGo, Inc. or its licensors. These Terms do not grant you any license or right to use any PayFarGo intellectual property other than as expressly stated herein.
You may not:
- Copy, reproduce, modify, distribute, or create derivative works of any PayFarGo content;
- Use PayFarGo trademarks or branding without prior written consent;
- Attempt to use the Platform to compete with PayFarGo or for any commercial purpose not expressly authorized.
10. Suspension and Termination
PayFarGo may, at its sole discretion, suspend, restrict, or terminate your access to the Platform and Services, with or without notice, if:
- You violate these Terms, our Acceptable Use Policy, or any applicable law or regulation;
- We detect or suspect fraudulent, suspicious, or unauthorized activity on your account;
- Required by law, regulation, court order, or governmental authority;
- You fail to complete required verification or provide requested documentation;
- You have outstanding unpaid fees or disputed chargebacks.
Upon Termination
- Your access to the Platform and any pending transactions will be suspended;
- All outstanding fees and obligations remain due and payable;
- PayFarGo may retain records of your account and transactions for periods required by applicable law (including BSA/AML record retention requirements of at least 5 years);
- You may contact PayFarGo to request information about any funds pending at the time of termination.
11. Limitation of Liability
OUR LIABILITY TO YOU IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
PAYFARGO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM OR SERVICES, EVEN IF PAYFARGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
PayFarGo's total liability to you for any direct damages arising from these Terms or your use of the Services shall not exceed the total fees paid by you to PayFarGo in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you depending on your state of residence.
12. Indemnification
You agree to defend, indemnify, and hold harmless PayFarGo, Inc., its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or in connection with:
- Your violation of these Terms;
- Your use or misuse of the Platform or Services;
- Your violation of any applicable law or regulation;
- Any false or inaccurate information provided by you;
- Any third-party claims arising from your conduct on the Platform.
13. Disclaimers and Warranties
THE PAYFARGO PLATFORM AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
PayFarGo does not warrant that:
- The Platform will be uninterrupted, error-free, or free of viruses or other harmful components;
- The results of using the Services will be accurate or reliable;
- Any defects in the Platform will be corrected.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the federal laws of the United States of America and, to the extent applicable, the laws of the state in which the relevant transaction or dispute arises. Users agree that by using PayFarGo's Platform, they submit to the personal jurisdiction of the courts of competent jurisdiction in the United States for any disputes not resolved through arbitration.
Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your state of residence, including rights under the CFPB Remittance Transfer Rule, the EFTA, or any applicable state money transmission law.
15. Dispute Resolution and Arbitration
15.1 Mandatory Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Except for claims that may be brought in small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform ("Dispute") shall be resolved exclusively by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in English and shall take place in the United States.
15.2 Class Action Waiver
YOU AND PAYFARGO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. IF THIS SPECIFIC PROVISION IS FOUND UNENFORCEABLE, THEN THE ENTIRETY OF THIS ARBITRATION PROVISION SHALL BE NULL AND VOID.
15.3 Informal Resolution
Before initiating arbitration, you agree to first contact PayFarGo at support@payfargo.com and describe the Dispute in reasonable detail. PayFarGo will use commercially reasonable efforts to resolve the Dispute informally within 30 days. If the Dispute is not resolved within 30 days, either party may proceed to arbitration.
15.4 Opt-Out
You may opt out of arbitration by sending written notice to PayFarGo within 30 days of the date you first create a PayFarGo account, to: PayFarGo, Inc., Attn: Legal Department, 2810 N Church St #692238 Wilmington DE 19802, United States.
Opting out does not affect any other provision of these Terms.
16. Electronic Communications and E-Sign Consent
By using PayFarGo's Platform, you consent to receive communications from PayFarGo electronically, including by email, push notification, in-app messaging, and SMS. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing, to the extent permitted by applicable law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and applicable state e-signature laws.
17. Modifications to Terms
PayFarGo reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last Updated" date at the top of this document and, for significant changes, by notifying you through your registered email address or via in-app notification. Your continued use of the Platform after such notice constitutes your acceptance of the revised Terms.
18. Transparency
This Website and the Services made available through it are provided on an "as is" and "as available" basis, without any representations, warranties, or conditions of any kind, whether express, implied, or statutory, except as expressly stated in writing. PayFarGo, its subsidiaries, affiliates, employees, directors, and agents expressly disclaim all implied warranties, including, without limitation, warranties of merchantability, fitness for a particular purpose, and non-infringement, in relation to the use of, or any service provided or sold through, this Website.
PayFarGo is not a financial institution. The Services are made available in partnership with a duly licensed and regulated financial institution which provides the underlying financial services.
While PayFarGo will use reasonable endeavours to facilitate the prompt processing of Transactions, it makes no representations or warranties as to the time required to complete any Transaction, except as may be expressly stated on the relevant receipt regarding the date of availability. Processing times may be affected by factors beyond PayFarGo's control. In jurisdictions where the exclusion of implied warranties is not permitted, the foregoing exclusions may not apply to you.
To the fullest extent permitted by applicable law, PayFarGo shall not be liable for any loss or damage of any kind arising out of or in connection with the use of this Website or the Services made available through it. This includes, without limitation, any loss or damage resulting from viruses, worms, bots, or other harmful or disruptive software that may affect your computer systems, hardware, software, data, or other property as a result of accessing this Website or using the Services.
