USER AGREEMENT

This User Agreement ("Agreement") is a legally binding contract between you and PayFarGo, Inc.

ACCEPTANCE OF AGREEMENT

BY CLICKING "I AGREE," CREATING AN ACCOUNT, OR USING THE PAYFARGO PLATFORM, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS AGREEMENT AND PAYFARGO'S PRIVACY POLICY AND FEE SCHEDULE.

IF YOU DO NOT AGREE, YOU MUST NOT CREATE AN ACCOUNT OR USE THE PLATFORM.

1. PARTIES AND PURPOSE

This Agreement is entered into between PayFarGo, Inc. ("PayFarGo," "we," "us," or "our"), a company incorporated in the United States and registered as a Money Services Business (MSB) with the Financial Crimes Enforcement Network (FinCEN), and you, the individual accessing or using the PayFarGo platform ("User," "you," or "your").

PayFarGo's purpose is to provide secure, reliable, and compliant international remittance services to members of the diaspora community residing in the United States, enabling them to transfer funds to recipients in supported destination countries.

2. DEFINITIONS

"Dashboard"Your personalised account management interface within the Platform.
"Destination Country"Any country to which PayFarGo supports remittance transfers.
"Fee Schedule"The current schedule of fees published at payfargo.com/fees.
"Funds"Money you deposit or instruct PayFarGo to transfer on your behalf.
"KYC"Know Your Customer -- identity and address verification procedures.
"Platform"The PayFarGo website, mobile application, APIs, and related tools.
"Privacy Policy"PayFarGo's data protection policy at www.payfargo.com/privacy-policy.
"Recipient"The designated beneficiary of a remittance transfer.
"Sender"A User who initiates a remittance Transaction.
"Transaction"Any instruction to remit, transfer, or move Funds via the Platform.

3. ACCOUNT CREATION AND ELIGIBILITY

3.1 Eligibility

To open and maintain an Account, you must:

  • Be at least 18 years of age.
  • Be a resident of or physically present in the United States.
  • Possess a valid, unexpired government-issued photo ID.
  • Hold a valid U.S. Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN).
  • Have a valid U.S. bank account, debit card, or other approved funding method.
  • Not be subject to any U.S. or international sanctions or listed on OFAC's SDN list.
  • Agree to and comply with this Agreement at all times.
3.2 Registration

You must complete the registration process accurately and in full. You agree to:

  • provide truthful, current, and complete information;
  • keep your Account information up to date;
  • maintain the confidentiality of your login credentials;
  • notify PayFarGo immediately at support@payfargo.com if you suspect unauthorised access.
3.3 One Account Per User

You may hold only one (1) active Account. Creating duplicate or fraudulent accounts is grounds for immediate termination and may be reported to relevant authorities.

3.4 Identity Verification (KYC)

PayFarGo is legally required to verify your identity. We may request the following at registration or at any subsequent time:

  • Government-issued photo ID (passport, driver's licence, or state ID card).
  • Proof of U.S. residential address (utility bill, bank statement, or lease dated within 90 days).
  • SSN or ITIN for regulatory and tax reporting.
  • Source-of-funds declaration or enhanced due diligence documents for high-value Transactions.
  • Selfie or biometric verification for remote identity checks.

Until KYC verification is complete, Transaction limits may be restricted. PayFarGo reserves the right to pause or decline Transactions pending satisfactory verification.

4. HOW THE PAYFARGO SERVICE WORKS

4.1 Initiating a Transfer

To send a remittance, you must:

  • log into your Account;
  • select the destination country and delivery method;
  • enter the Recipient's details accurately;
  • specify the amount to be sent;
  • review and confirm all pre-transaction disclosures;
  • authorise payment from your linked funding source.
4.2 Pre-Transaction Disclosures

Before you confirm any Transaction, PayFarGo will display in clear, plain language:

  • The exact amount to be transferred in U.S. dollars.
  • All fees charged by PayFarGo.
  • The exchange rate applied and any margin included.
  • Any third-party fees (where known).
  • The estimated amount the Recipient will receive in the destination currency.
  • The estimated date and time funds will be available to the Recipient.
  • Your cancellation and error-resolution rights.
4.3 Authorisation and Debit

By clicking "Confirm and Send," you authorise PayFarGo to debit your linked payment method for the full Transaction amount (including all fees) and to initiate the remittance to the Recipient. This authorisation is your electronic signature and carries the same legal weight as a handwritten signature.

4.4 Processing Times

Transactions are typically processed within one (1) to five (5) Business Days, depending on the destination country, delivery method, and correspondent banking partners. Express delivery options may be available for an additional fee. Processing times are estimates and are not guaranteed.

4.5 Recipient Information Accuracy

You are solely responsible for the accuracy of all Recipient details you provide, including full legal name, bank account number, routing/SWIFT/IBAN code, and contact information. PayFarGo shall not be liable for failed, misdirected, or delayed Transactions resulting from incorrect information provided by you.

5. FEES, EXCHANGE RATES, AND PAYMENT

5.1 Service Fees

PayFarGo charges a service fee for each Transaction. The applicable fee is displayed before you confirm your Transaction and is detailed in the Fee Schedule at payfargo.com/fees. Fees may vary by destination country, payment method, transfer amount, and delivery speed.

5.2 Exchange Rates

PayFarGo applies its own exchange rate, which includes a margin above the mid-market (interbank) rate. The rate applicable to your Transaction is locked at the moment of confirmation. PayFarGo makes no representation that the rate offered is the best available in the market.

5.3 Accepted Payment Methods

PayFarGo currently accepts:

  • ACH bank transfer (U.S. bank accounts).
  • Debit cards (Visa and Mastercard).
  • Other methods as published on the Platform from time to time.
  • Credit card payments and cash are not accepted.

PayFarGo reserves the right to modify accepted payment methods at any time with reasonable notice.

5.4 Insufficient Funds and Failed Payments

If your payment is declined or reversed (e.g., insufficient funds or chargeback), the Transaction will be cancelled and PayFarGo may charge a returned-payment fee as set out in the Fee Schedule. Repeated failed payments may result in Account suspension.

6. CANCELLATION, ERROR RESOLUTION, AND REFUNDS

6.1 Right to Cancel

In accordance with the Dodd-Frank Act (15 U.S.C. Section 1693o-1) and Regulation E, you may cancel a Transaction within thirty (30) minutes of authorisation at no cost, provided funds have not yet been deposited to the Recipient or released to a payout partner. To cancel, contact PayFarGo at support@payfargo.com or use the cancellation option in your Dashboard.

6.2 How to Report an Error

If you believe an error occurred in connection with a Transaction, please:

  • Contact PayFarGo at support@payfargo.com or call our helpline at +1 (929) 704-9715.
  • Provide your name, Account number, Transaction reference, the error description, and the dollar amount.
  • Submit your report within one hundred eighty (180) days of the Transaction date.
6.3 Investigation and Resolution

PayFarGo will acknowledge your error report promptly and complete its investigation within ninety (90) days. We will notify you of our findings and, if an error is confirmed, will:

  • refund the amount and all fees;
  • reprocess the Transaction correctly;
  • provide an explanation if no error is found.
6.4 Refund Processing

Confirmed refunds will be returned to your original payment method within five (5) to seven (7) Business Days. Exchange rate differences and third-party fees may not be refundable in all circumstances.

7. YOUR RESPONSIBILITIES AND PROHIBITED CONDUCT

7.1 Your Responsibilities

You agree to:

  • Keep your Account credentials secure and not share them with any other person.
  • Ensure all information you provide to PayFarGo is accurate, current, and complete.
  • Use the Platform only for lawful, personal remittance purposes.
  • Verify all Recipient details before confirming any Transaction.
  • Promptly inform PayFarGo of any changes to your personal or contact information.
  • Co-operate fully with PayFarGo's KYC, AML, and compliance procedures.
  • Comply with all applicable U.S. federal and state laws and regulations.
7.2 Prohibited Conduct

You must NOT use the Platform to:

  • Engage in, facilitate, or conceal money laundering, terrorist financing, or any financial crime.
  • Send funds on behalf of any undisclosed third party (i.e., act as an unlicensed money transmitter).
  • Circumvent any OFAC sanctions or U.S. export control laws.
  • Structure Transactions to evade currency reporting thresholds.
  • Commit fraud, identity theft, or misrepresentation of any kind.
  • Transfer proceeds of any criminal or illegal activity.
  • Use the Platform for commercial or business purposes without written authorisation.
  • Attempt to reverse-engineer, hack, or disrupt the Platform or its systems.
  • Harass, threaten, or abuse PayFarGo staff or other users.

Breach of these obligations may result in immediate Account suspension or termination, Transaction reversal, reporting to law enforcement agencies, and civil or criminal legal proceedings.

8. ACCOUNT SECURITY

8.1 Security Measures

PayFarGo employs industry-standard security measures including encryption (TLS/SSL), multi-factor authentication (MFA), and continuous fraud monitoring. You are encouraged to enable MFA on your Account at all times.

8.2 Your Security Obligations

You are responsible for:

  • Creating a strong, unique password for your Account.
  • Enabling multi-factor authentication.
  • Logging out of your Account after each session on shared or public devices.
  • Immediately reporting any suspected unauthorised Account activity to support@payfargo.com.
8.3 Liability for Unauthorised Transactions

PayFarGo's liability for unauthorised Transactions is governed by the Electronic Fund Transfer Act (EFTA) and Regulation E. Your liability may be limited provided you notify us promptly. Please review your Account statements regularly and report any discrepancies within sixty (60) days.

9. PRIVACY AND DATA PROTECTION

Your privacy matters to PayFarGo. Our Privacy Policy (available at www.payfargo.com/privacy-policy) explains how we collect, use, store, share, and protect your personal data. Key points:

  • We collect personal and financial data necessary to provide remittance services and comply with the law.
  • We share data with correspondent banks, payout partners, and regulators as required.
  • We comply with the Gramm-Leach-Bliley Act (GLBA), applicable state privacy laws (including CCPA for California residents), and all other applicable U.S. data protection frameworks.
  • We do not sell your personal data to third-party advertisers.
  • You have rights to access, correct, and (where applicable) delete your personal data - contact privacy@payfargo.com.

10. REGULATORY AND COMPLIANCE OBLIGATIONS

10.1 AML and Sanctions Compliance

PayFarGo maintains a comprehensive Anti-Money Laundering (AML) and sanctions compliance program. You acknowledge that PayFarGo may:

  • Monitor all Transactions for suspicious or unusual activity.
  • File Suspicious Activity Reports (SARs) or Currency Transaction Reports (CTRs) with FinCEN without prior notice to you.
  • Delay, block, freeze, or reverse any Transaction suspected of violating AML or sanctions requirements.
  • Screen all Transactions against OFAC's Specially Designated Nationals (SDN) list and other sanctions databases.
  • Share information with law enforcement, regulators, or government agencies as required by law.
10.2 Tax Reporting

PayFarGo may be required to report Transaction data to the Internal Revenue Service (IRS) and other tax authorities. We may issue IRS Form 1099 or other tax documents where required. You are solely responsible for your own tax obligations arising from your use of the Platform.

11. SUSPENSION AND TERMINATION OF ACCOUNT

11.1 PayFarGo's Right to Suspend or Terminate

PayFarGo may suspend or terminate your Account at any time, with or without prior notice, for reasons including:

  • Breach of this Agreement or any PayFarGo policy.
  • Failure to complete or maintain KYC/AML verification.
  • Suspected fraudulent, illegal, or suspicious activity.
  • Legal or regulatory requirements.
  • Account inactivity for twelve (12) consecutive months.
  • Risk management or security concerns at PayFarGo's reasonable discretion.
11.2 Your Right to Close Your Account

You may close your Account at any time by contacting support@payfargo.com. Account closure does not relieve you of obligations for pending or completed Transactions. Any remaining balance will be returned to your linked payment method, subject to verification.

11.3 Unclaimed Funds

Funds remaining unclaimed in a closed or dormant Account will be handled in accordance with applicable state unclaimed property (escheatment) laws. PayFarGo will make reasonable efforts to contact you before reporting any funds to state authorities.

12. INTELLECTUAL PROPERTY

All content, software, designs, logos, trademarks, and intellectual property on the Platform are the exclusive property of PayFarGo, Inc. or its licensors. You are granted a limited, personal, non-transferable, non-exclusive, revocable licence to access and use the Platform for lawful personal remittance purposes only. You may not copy, reproduce, modify, distribute, or create derivative works from any PayFarGo content without prior written consent.

13. DISCLAIMERS AND LIMITATION OF LIABILITY

13.1 Service Disclaimer

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY, EXPRESS OR IMPLIED. PAYFARGO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

13.2 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PAYFARGO'S TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF:

FEES YOU PAID TO PAYFARGO IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR

ONE HUNDRED U.S. DOLLARS ($100).

PAYFARGO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW EXCLUSION OR LIMITATION OF CERTAIN DAMAGES - IN SUCH STATES, LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PayFarGo, its officers, directors, employees, agents, and successors from any claims, liabilities, losses, damages, and expenses (including reasonable legal fees) arising from:

  • your breach of this Agreement;
  • your use or misuse of the Platform;
  • any Transaction you initiate;
  • your violation of any law; or
  • any third-party claim relating to your conduct.

15. DISPUTE RESOLUTION AND GOVERNING LAW

15.1 Informal Resolution First

Before filing any formal claim, you agree to contact PayFarGo at legal@payfargo.com and attempt to resolve the dispute informally. PayFarGo will respond within thirty (30) days.

15.2 Binding Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted on an individual basis in English in the United States.

15.3 Class Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTION LITIGATION OR CLASS-WIDE ARBITRATION. ALL DISPUTES MUST BE BROUGHT INDIVIDUALLY.

15.4 Governing Law

This Agreement is governed by the laws of the State of Delaware, without regard to conflict-of-law rules, except where federal law governs. Nothing in this section affects your rights under applicable state consumer protection legislation.

15.5 Regulatory Complaints

You have the right to submit a complaint to:

  • The Consumer Financial Protection Bureau (CFPB) at consumerfinance.gov/complaint.
  • Your state banking regulator (see payfargo.com/licenses for state contacts).
  • The Federal Trade Commission (FTC) at reportfraud.ftc.gov.

16. CHANGES TO THIS AGREEMENT

PayFarGo may update this Agreement at any time. We will notify you of material changes at least thirty (30) days before they take effect, via email to your registered address and/or a notice on the Platform. Your continued use of the Platform after the effective date of any change constitutes your acceptance of the revised Agreement. You may close your Account before the effective date if you do not accept the changes.

17. GENERAL PROVISIONS

17.1 Entire Agreement

This Agreement, together with the Privacy Policy and Fee Schedule, constitutes the entire agreement between you and PayFarGo and supersedes all prior understandings.

17.2 Severability

If any provision of this Agreement is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the rest of the Agreement remains in effect.

17.3 No Waiver

Failure by PayFarGo to enforce any provision does not constitute a waiver of that or any other right.

17.4 Assignment

You may not assign your rights under this Agreement. PayFarGo may assign this Agreement in connection with a corporate reorganisation, merger, or sale of assets.

17.5 Force Majeure

PayFarGo is not liable for failures resulting from events beyond its reasonable control, including acts of God, government orders, cyberattacks, pandemics, or natural disasters.

17.6 Relationship of Parties

Nothing in this Agreement creates a partnership, employment, agency, or joint venture relationship between you and PayFarGo.

17.7 Language

This Agreement is in English, which is the controlling version. Translations are for convenience only.

ACKNOWLEDGEMENT

By creating an Account or using the PayFarGo Platform, you acknowledge that you have read, understood, and agree to be legally bound by this User Agreement, the Privacy Policy, and the Fee Schedule, each as amended from time to time.
